I'm Michael from Consumer Recovery Network. I'm a debt geek. Been one since '94. I founded Consumer Recovery Network back in 2004. I created this channel as a means to directly, and freely, help people with their debt right from my office. I share what I know about debt settlement, consolidation, negotiating, credit counseling, bankruptcy, collections, and even things to look out for. Debt is unique to each person or family. What works for one person may not work for another, and I want to help you find the right fit to meet your financial goals. The debt industry, being so saturated with information, can make it tough to sort out - what's true and what's not, or what works and what doesn't. My hope is that this channel, and the information contained within it, will shine a light on the realities of getting out of debt.
If you have a question that isn't covered here, please ask! I'll be happy to answer your questions in the comments, or maybe even spotlight it in one of my videos.

Settled for Less VS Paid in Full on Your Credit Report
Settled for Less VS Paid in Full on Your Credit Report

It may seem like "paid in full" is a more desirable outcome on your credit report, but the reality is, in the credit industry, there's one big thing that nullifies the potential difference between "paid in full" and "settled for less". If you have collections and care about improving your credit you will want to know how to best reach your goals. "Pay off Debt - Your Birth Certificate is Worth Millions" - Busting Myths
"Pay off Debt - Your Birth Certificate is Worth Millions" - Busting Myths
2 years ago
We're busting myths and today, and discussing an unusual way people are trying to pay their bills and other debts - using popular conspiracy theories to access "secret" Treasury Direct Accounts. STRAWMAN/REDEMPTION CONSPIRACY ▶︎Brief history / Asserts the federal government granted a birth certificate (name in all caps - the "straw man" - also on social security, taxes, etc) and that the US government has "secret" trust accounts linked to each citizen. (Been used to avoid taxes; taxpayer claims they're not responsible for tax obligation of "straw man") BIRTH CERTIFICATE ▶︎Asserts the birth certificate "bond" created when you were born that prepays all of your debts. (US government declared bankruptcy in 1933 when the country went off the gold standard. Claims that the bankrupt country, in an effort to prevent foreclosure, pledged all Americans to “International Bankers” as collateral for the national debt. As a result, we are all slaves, and our birth certificates are traded on the markets as bonds worth millions.) ▶︎The IRS has categorized "redemption", "strawman", and "Bond Fraud" under Scams and Safety. UCC CODES ▶︎Acceptance for Value ▶︎Sight Drafts / Bills of Exchange / Promissory Bonds ▶︎"Drawing such drafts on the U.S. Treasury is fraudulent and violation of federal law." - Treasury Dept. ▶︎"It is a violation to Federal Law to misuse the Treasury seal or the words, titles, symbols, or emblems of the Treasury Department, or any service, bureau, office or Treasury subdivision; see 31 U.S.C. 333." SOCIAL SECURITY ▶︎Claims you can access your "secret trust" aka your "TDA" or Treasury Direct Account using your social security number and Federal Reserve routing number. ▶︎"Individuals do not have accounts at the Federal Reserve. The Federal Reserve provides banking services only for banks. Individuals do not have accounts at the Federal Reserve." - Federal Reserve Bank of Atlanta ▶︎"Law enforcement, including the Federal Bureau of Investigation (FBI), is aware of this scheme, and the Federal Reserve Banks, including the New York Fed, have been cooperating with law enforcement in their investigations. Individuals who participate in such schemes could face criminal charges." - Federal Reserve Bank of New York POSSIBLE OUTCOMES: ▶︎Those who have already tried these fraudulent forms of paying debt have already learned that it does not work. Federal Reserve Banks do not hold individual accounts, so your "payment" will be reversed or rejected and when it is, you will not only still owe the debt, but likely have incurred additional fees and may even have been sued, making yourself a candidate for wage garnishment or levy. ▶︎You will see claims that it worked in comment threads and such, but no real, long-term proof has ever been shown, to my knowledge. ▶︎In addition, you may find yourself slapped with hefty fees, fines and penalties, under FBI investigation, arrested and/or charged with a crime. ***RESOURCES*** FBI - www.fbi.gov/scams-and-safety/common-fraud-schemes/redemption-strawman-bond-fraud FTC - www.consumer.ftc.gov/blog/2017/08/no-secret-bank-accounts-pay-your-bills US Dept. of the Treasury - www.treasury.gov/about/organizational-structure/ig/Pages/Scams/Bogus-Sight-Drafts.aspx Treasury Direct www.treasurydirect.gov/instit/statreg/fraud/fraud_bogussightdraft.htm US Dept. of the Treasury - www.treasury.gov/about/organizational-structure/ig/Pages/fraud-alerts_index2.aspx Federal Reserve Bank of Atlanta - www.frbatlanta.org/news/pressreleases/atlantafed/2017/0712-consumer-scam-alert-fr-routing-numbers Federal Reserve Bank of New York - www.newyorkfed.org/banking/frscams.html IRS (See #8) - www.irs.gov/privacy-disclosure/the-truth-about-frivolous-tax-arguments-section-i-d-to-e#anch_83 IRS (See Rev. There is no one way to negotiate a debt. And there is no set pattern of calls you can make to a debt collection agency. But there are some basics to the process. Calling a debt collector and trying to get too much done in one phone call can play to their strengths, and not yours. In this video I cover different strategies for making your calls to debt collectors in order to negotiate the best strategies over a series of phone calls and time. Settling private student loans works well for those who are unable to keep up with their payments. Companies like Navient, National Collegiate Trust (NCT), Wells Fargo, Discover, and others, do offer an ability to resolve your loans with them. And until it becomes more common to be able to discharge private loans through a chapter 7 bankruptcy, negotiating lower pay offs can provide the relief you need. Settling Judgment Debt: Getting Real About Expectations
Settling Judgment Debt: Getting Real About Expectations
3 years ago
If you were sued for collection in the past, the judgment in the court will have grown with interest. The longer you go without resolving the debt, the bigger it becomes, and the longer you could be at risk for wage garnishment, lien, or a bank levy. Resolving your judgment debt by negotiating and paying less is often required before you can move on with financial goals. But you must be prepared to negotiate differently than if you were not sued, and know that you will often have to pay more to settle legal debts too. If you are sued for collection, and a judgment goes against you, you have to be concerned about extraordinary methods attorneys have to make you pay. If they cannot figure out how to garnish your wages, or levy your bank account, collection lawyers may send you forms to fill out to help them. And they can sometimes get the courts to notice you to appear in order to ask you questions about your assets and income. Being in debt in your retirement years, and considering bankruptcy, can be extra frustrating because you really want to preserve as much money as you can. This makes your choice in debt relief extremely important, so we have to weigh the cost, circumstances, and goals carefully. Should you pay companies to dispute your debt or is it a scam?

You don't need a company to dispute debt for you, and if you do, you may end up getting scammed in the end. There are companies out there who use questionable tactics, like disputing a debt you actually owe, to prevent you from having to pay your debt. If you want to ignore your debt, go ahead, but don't allow these companies to charge you for doing it. DIY Debt Settlement is not for everyone. There are people who can absolutely settle their own debt, but you have to be able to recognize whether you're the right person for the job BEFORE you attempt to negotiate, because you could do more harm than good if you're not. I’ve been approved by a settlement program California debt relief and have my first payment due soon however I checked the mail and saw a letter from this law firm. I want to say that for months these collectors were calling my family and Robo messaging them about my debt and that they were going to sue if I don’t respond by a certain time. But I’m already in a settlement program do I contact to let them know that all communication should go to them of course I was harassed and got threatened with legal action but I just want to end it but don’t know where to go from here.

HI Michael - Thanks for helping me thus far - multiple phone calls and emails and always been helpful.. Appreciate what you do!!!! I have 16K with Chase that is reported as 30-59 days late with worst payment stats as 60-89 days late. Citi will settle for 6600 or a payment plan for 60 months for full balance. Question is exactly what you referenced in this video but Im not 90 days late - would like to settle but dont want my score to drop anymore.. currently 536-550 based on agency. Thoughts on settle vs payments - and can i dispute later and somehow knock this off my credit report? Thanks again!!

Hi Michael. I have delinquent credit card accounts with Chase & PNC. I have heard that they are not selling it to the collection agencies and also they are not suing. So Can i keep the debt as it is without doing settlement ? What could be the possible consequences in that scenario? I am okay, if my credit report takes a blow. And as long as there is no legal implications or collection agencies trying to chase me. Please do provide your suggestion.

I say, there may not be an account with money in it BUT I will say this: In spite of all the theories of the "straw-man" etc, knowing how crooked government entities are, perhaps most of it IS correct however, the logistics and process of it is so twisted and intertwined that the average human could not possibly understand how it works so that's why they fail. Someone, somewhere created all these "systems" of oppression therefore it is only logical to believe that deep, deep, deep down under all the numbers, names and agencies i.e. The federal Reserve which BTW is not a federal agency, there is a scam going on, we as citizens just are not equipped or educated enough to expose the truth. We can only assume.

I suggest you do some more research, the account is not with the Federal Reserve you are correct it is with the Department of the Treasury, the private side of the accounting system. In order to understand that you have to learn double bookkeeping entry. The registered letter you send to Mr. Mnuchin with your Birth certificate (for the public side to discharge debt) and your Certificate of Live Birth for the private side to credit off set the accounts) becomes your account number aka RE 123 456 789 US. People that correct their political status are not eligible for TDA's. TDA's are for US citizens. The all caps name operates on the public side, upper and lower case name operates on the private side. People get in trouble because they do not study accounting and trust law. Mixing public with private is what gets them in trouble.

Michael I have a capital one card for 16K that I can't afford the $400+ payments monthly due to loss of employment. I just got a new job but I am 2-3 months behind already and I won't be able to catch up on that. To bring my account current they want the entire past due balance paid at once which is impossible and they aren't willing to do anything else. Should I just wait until I hit 6 months past due and give them a call? I tried everything witb them so far and no luck. I also have another card for $1700 witb them but I'm paying on that as normal. It won't hurt me that I'm paying my other card will it? Thank you

Hi Michael, I hope you're still active on this account. Your videos are very useful! Quick question: I had a balance of $10,600 with Citi. I am not 100% sure it's been charged-off but it's been over 6 months since my last payment so I imagine it has. I got a letter from GC Services about the debt. I responded asking for "debt verification", and they responded to that with a settlement offer on behalf of Citibank to settle at 40% for $4,200. I have that and would like to just settle. Do you think it is safe to mail them a money order? They want a check made out to CITIBANK, NA. Their offer is on their (GC Services') letterhead and says, "...our client, Citibank NA, has authorized us to make you a settlement offer on your account. If you pay 40% of the total balance due, our client will consider your account settled." I know it will remain on my credit report as "settled" or "paid less" etc, but they (Citibank or any other agency) cannot come after me anymore if I pay this offer, correct? The letter isn't signed with a penned signature, but ends with "Sincerely, Dan K***" (I hid the last name here) and "Account Representative" under that name. I just want to be sure if I pay this settlement offer that it will indeed SETTLE the account and I won't accrue any more fees or have anybody else telling me "You never settled this debt" etc etc. Thank you for any help!

Chase sent me a 10% settlement offer for an old CC debt I hadn't paid on in two years. It was split into two payments. I was frankly ecstatic to see this because it was all I could afford. I made the first payment on it today. I was told over the phone I'd get some post payment paperwork saying it is settled, so that is good. I figured if I didn't settle they could at any time change their business methods and sell the account to a collection agency. Then I would have a big nightmare.

I am legally blind and use a power chair. I am on a very low fixed income on SSI and SSDI. I get about 700.00 per month on both of those checks. I get 75.00 in Food Stamps SNAP. In 2017 a very good friend of mine that I knew since Jr High in 1992. Both her and her husband who are in wheelchairs and disabled as well on low fixed incomes needed to make a more. They didn't have the credit to get the funds to get settled in their new apartment and so my friend of over 26 years asked me if it would be okay we all could get on a credit card and ALL of our names would be on the card and it would effect ALL of our credit the same. Because I am legally blind and she was someone I TRUSTED very highly and because she has helped me when ever I needed help whether I needed help filling out a form or other things like I needed help with an online account getting logged back in etc. She had ALL of my information like SSN, Birth Date you name it. She said to me "If you need help I will help find the best credit card to set up and because I use to work for Discover in High School on the Boost Program I know how to do this. If we charge something on the card we will pay for our purchases to get settled in our new apartment. If you (myself) make a purchase on the card you will have to pay for those purchases". I let her know that it was okay to see ans so she took a little bit of time and came back to me and let me know that she was able to get an approval that ALL of us were on a card together. (Note: I Never Planned To EVER Make ANY Purchases What So Ever On That Card). What I found out later is that my friend and her husband had signed ME up and just put themselves an "Authorized Users" on the card and then they changed the Address, Email & Phone number from mine to themselves and so they had access to everything and I didn't have the access at all. I never was able to see what was being charged. They had charges on places like Amazon, American Airlines and even places like Penn Foster etc. There were local Wichita Kansas purchase even to a places that her husband worked for before they got married called Ribbet Computers for the same person that he worked for before. There was a large purchase from that place. The sad thing is that they did pay the bill for a while and they kept purchasing things but paying and at one point charged over 15,000.00 on a card that had a 9,000.00 credit limit on it to begin with. I had no idea that they had reoccurring purchases on the card. Sadly on 07 FEB 2019 my friend passed away. Her husband never let me know and he never talked to me at all. I found out from my credit union in SLC Utah that this high bill was on my credit and that they had missed payments and stopped paying the bill. I found out all about the amounts and what was going on until just a few day't before the date when she passed away. They say I owe them over 7,000.00 dollars. I Hate MONEY! I believe that Money & Credit Cards which I call (DEBT CARDS) are nothing but a for of $LAVERY! I guess it really doesn't matter how long you know someone because Trust doesn't have any real VALUE? I was trying to pay off my MACU Credit Card and that won't be a possibility since I was stiffed with this bill that I thought I never would be stiffed with. I was planning on taking care of my Mountain America Credit Union Credit Card Bill because I wanted to make shore that I could have a good relationship with them but It would be nice to get that paid off and find a way to somehow get rid of Discover Debt Card and start SAVING Money for myself??? I now eat Expired Food from a Food Box and only have no more than 75.00 dollars in SNAP Food Stamps. How can someone get a good credit score without getting into debt even if they owe someone like Discover Debt Card but save money to do it without losing governmental benefits???

I recently had wages garnished for an erroneous default judgement (thats a story for another day), and for the life of me I cant figure out how they figured out where I work? I just started working for the company, told no one, never applied for any credit and definitely did not list the new employer on my credit file, never hummed a word on social media, I am at a loss. I recently froze my LexisNexis file but not sure if this was the method used because Lexis never reported the new employer. Any ideas here? Do you think they look at IRS 1040? I am very private and never ever list my employer on anything.

At 82, I own nothing: no home; no car; absolutely nothing. I have a smartphone and iPad and old PC. I am computer literate. I exist on SS month-to-month. The amount is $6 above the poverty level amount. So I don’t qualify for Medicaid to pay for the Social Security Insurance deduction of $130 something. I would buy hearing aids; eye glasses; dental work; but no money to do so. I pay less than $1,000. for prescriptions and slightly less than $500. for mineral & vitamins. I have nothing left to pay mounting medical bills. I don’t respond to any medical billings and they remain unpaid. Basically I don’t have anything of any value. AM I JUDGMENT PROOF?

I recently contacted and agreed to pay National Debt Relief to help me settle my credit card debt. I signed up because they have very good reviews and a A+ rating in BBB. After continuing to search the company and Global Client Solutions I noticed a lot of things I was concerned about. Like one for example was that the companies don’t do what they promise and hide a lot of hidden fees along with other information regarding how the program actually works. I’m worried now and I’m debating if I should just cancel the program and try and settle my own debt by calling my Collection companies instead. Any help would be gladly appreciated and thank you

What about Debt collector Law firm, that received a default judgment in Feb 2015, and then waited to contact me until after the terms of the limitations to drop the judgment had passed? and I just received correspondence to write a Validity letter September 2019.

Hey there Micheal, I called up capital one since i was unable to set up an payment plan that reduced my balance of up to 50% in 7 payments. Capital have gave me that option on sept 20/21 via email. But was discourage since they’ve told me over the phone that my account has been charged off and now rests in the hands of Hunt and Henriques Law firm. I called Hunt and Henriques today to see what was going on with my account they told me that they have just gotten my account and they still needed to set up some paperwork for it and they couldn’t not tell me anything about it yet. They told me to call in a few weeks ..... hmmm

Hello Michael! I just wanted to say thank you for posting all this information on RUvideos and on your website. Over the past two years I have been settling a significant amount of debt and have avoided having to file a chapter 13 bankruptcy. So far, I have settled $42,000 in debt for about $10,000. While I am not yet finished, I am nearly done and could not have gotten out of this situation without the help and information you provided.

Thank you I'm a new subbie and I appreciate you and this information. I have two charge offs. One is from Target. I made payments consistently from 2005 until 2016 never missed a payment or late because I had it tied to my checking account. In Dec 2016 I was sick and took a medical leave of absence for six months. I contacted target and informed of this and that I wanted to use the insurance that I had taken out on the credit card with them, to make my purchases. That was never applied. So now fast fwd 3 yrs. I had green for 10 years with them and now I have a charge off for $1200. How do I make that a positive? The other debt is a gas bill that I had 4 or 5 years ago. They have recently started to call and harass me as well as put the debt on my credit in June 2019 even though it wasn't there all along. Any help is mucho appreciated.

Sorry but you are speaking of something you have not enough knowledge on, and its folks such as yourself, speaking in forked tongue that messes it all up. First off, its not called a BOND, it is actually called the Cesta Que Trust, and every living flesh, blood flowing soul has it on them. It is attainable BUT you cannot attain it until you are FREE. That means, you are no longer a UNITED STATES CITIZEN, go the Blacks law dictionary 5th Edition and look up the definition of UNITED STATES. It will TELL you it is a CORPORATION. There is an unincorporated united States wherein we are a part of. It has NEVER gone bankrupt, but the CORPORATION HAS. The powers that be, view that trust as THEIRS and plenty have gone to jail to scare the beegeebees out of folks who are trying to attain it, that does NOT mean its not there. A JUSTICE of the United States Supreme Court retired judge Dale Chase spilled the beans on it all, ALL COPS, ALL CLERKS, ALL JUDGES, ALL ATTORNEYS AND LIKELY MOST OF THE SHERIFF depts IN THE WORLD are a party to the scam in a CRIMINAL ENTERPRIZE. The walls are COMING DOWN. It will be released SOON, according to another Judge Anna Von Rietz in a breaking story I just recanted of her released information. Have a good one, and please in the future, DO YOUR RESEARCH BEFORE PUTTING OUT UNTRUTHS, AND MESSING IT UP FOR ALL OF US THAT ARE TRULY TELLING THE TRUTH!!!!!!!!!!!!!! SHAME ON YOU! I DARE SAY, YOULL DELETE MY COMMENT, BUT IF YOU DO, KNOW THAT ITS BEEN CAPTURED AND YOU WILL EXPOSED FOR BEING A LIAR!

I had a 30 day late payment with Kohl’s which is my first ever, I have 100% payment history with all of my credit cards. I simply forgot and then called and paid my balance in full. I sent a letter to the CEO and another executive explaining my excellent history with kohl’s and what had happened. Do you think they will go ahead and delete my late payment?

This all makes sense for money that you've physically spent, such as a credit card. What about medical debt where you don't even have a dollar amount for your services until weeks or months later?

Hi, I’m currently dealing with gate stone. And I have one credit card that I haven’t paid in almost a year it was originally $1000. On my credit it karma it shows $1137, but it’s not under collections, it’s under revolving... (which I also don’t know what that means) I spoke with a representative and she told me that with interest to this date my debt is at $1485 now!!! And we talked and she was able to get it down to $1100 . Which is honestly perfect. Also mind you I live in Canada. There’s been a lot of scams lately and I’m concerned about the legitimacy of this company and that they will be able to consume the rest of my debt as promised and also take this debt off my credit. I need a little guidance on what to do, in your video you said to trust them, but you’re in America. Also I’ve been reading some reviews about gatestone and in some cases people pay the money and then don’t get the balance taken off their credit. Or another agency tries to call them for collection. I have the money, and I just want to settle my debt once and for all. But I’m not sure if I can trust them

I know it's not a better set up, but what about paying it in full so as to not deal with the hassle of the rest being written off as income for me? Mind you I don't have anything astronomical but I have a debt or two I just can't pay in one payment.

I had a debt collector take me to court. I won the case because there was no contract binding me to the collector. So I did not have to pay collections. I've never paid collections and my debts are no longer on my record.

Old black laws books actually show definitions such as "strawman"... i doubt the gov would tell u "hey guys stop, were going broke since u figured it out haha" just sayin. Im on the fence regardless. Seems from my years of research and chasing my tail on this, even if u do use this "account", you take money out of your ss account for when yr older. Ive seen people do this and their account drops in numbers. The exact number they were spending. I also saw big payments get rescinded. And smaller payments left alone. Yet when u call these banks they usually cant say why. Probably would be better to refrain from numbers and fake money altogether. Thats why amish etc can opt out of "citizienship" and a number, ie being sovereign. Theres something to this. But all the info isnt out there so noone can see the entire picture.

I have almost all my debt paid off from a bad year of being out of work. I have one left I need to get started paying off in beginning of 2020. This is $21,000 and from 2017. I haven't heard from them yet, and its been in charge off this whole time. Even my credit is going back up to fair from very poor. Should I negotiate with them? I don't want to wait till it is in collections and it drops my score again. Thanks !
